Accommodation Agreement

  • Article 1 (Scope of Application)

    1. Accommodation agreements and other related agreements to be entered into between the Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. And any particulars not provided for herein shall be governed by the applicable laws and regulations and/or generally accepted practices.
    2. Notwithstanding the preceding Paragraph, if the Hotel enters into a special agreement with the Guest, the special agreement shall take precedence, insofar as it does not violate laws and regulations and generally accepted practices.
  • Article 2 (Application for Accommodation Agreement)

    1. A Guest who intends to make an application for an Accommodation Agreement with the Hotel shall notify the Hotel of the following particulars:
      1. Name of the Guest (s);
      2. Date of accommodation and estimated time of arrival;
      3. Accommodation charges (based, in principle, on the Basic Accommodation Charges listed in the attached Table No.1); and
      4. Other particulars deemed necessary by the Hotel.
    2. If the Guest requests, during the period of accommodation, an extension of accommodation beyond the date provided pursuant to Item (2) of the preceding Paragraph, it shall be regarded as an application for a new Accommodation Agreement at the time such request is made.
  • Article 3 (Conclusion, etc. of Accommodation Agreements)

    1. Accommodation agreements shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, this shall not apply when it is proven that the Hotel has not accepted the application.
    2. Upon conclusion of an Accommodation Agreement in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an accommodation deposit stipulated by the Hotel within the limits of the Basic Accommodation Charges covering the period of stay (or 3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
    3. The deposit shall be first used to cover the Total Accommodation Charges to be paid by the Guest, then secondly, any applicable cancellation charges under Article 6, and thirdly, any appliable reparations under Article 18. The remainder, if any, shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
    4. If the Guest fails to pay the deposit by the stipulated date, as set forth in Paragraph 2, the Hotel shall treat the Accommodation Agreement as invalid. However, this shall apply if and only if the Guest has been informed of the deadline by the Hotel, when the payment deadline of the deposit is specified.
  • Article 4 (Special Agreements Requiring No Accommodation Deposit)

    1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special agreement requiring no accommodation deposit after the Accommodation Agreement has been concluded, as stipulated in the same Paragraph.
    2. If the Hotel does not request payment of an accommodation deposit as stipulated in Paragraph 2 of the preceding Article and/or does not specify a deposit payment deadline at the time of accepting an application for an Accommodation Agreement, it shall be construed that the Hotel has accepted a special agreement as prescribed in the preceding Paragraph.
  • Article 5 (Refusal of Accommodation Agreements)

    1. The Hotel reserves the right not to conclude an Accommodation Agreement under any of the following cases:
      1. When the application for accommodation does not conform with the provisions of these Terms and Conditions;
      2. When the Hotel is fully booked and no room is available;
      3. When the Guest seeking accommodation is deemed liable to behave in a manner that violates laws or regulations, or that is contrary to public order or good morals with respect to accommodation;
      4. When the Guest seeking accommodation is clearly carrying an infectious disease;
      5. When the Hotel is requested to assume an unreasonable burden with respect to accommodation;
      6. When the Hotel is unable to provide accommodation due to natural calamities, disfunction of the facilities, and/or other unavoidable causes; or
      7. When the provisions of Article 16 of the Nagano Prefectural Ordinance for Enforcement of the Hotel Business Act are applicable.
  • Article 6 (Right to Cancel Accommodation Agreements by the Guest)

    1. The Guest may cancel the Accommodation Agreement by so notifying the Hotel.
    2. If the Guest does not appear by 7:00 p.m. on the date of accommodation (or 2 hours after the expected time of arrival if the Hotel has been notified such arrangements) without an advance notice, the Hotel may regard the Accommodation Agreement as having been cancelled by the Guest.
    3. If the Hotel does not request payment of an accommodation deposit as stipulated in Paragraph 2 of the preceding Article and/or does not specify a deposit payment deadline at the time of accepting an application for an Accommodation Agreement, it shall be construed that the Hotel has accepted a special agreement as prescribed in the preceding Paragraph.
  • Article 7 (Right to Cancel Accommodation Agreements by the Hotel)

    1. The Hotel may cancel the Accommodation Agreement under any of the following cases:
      1. When the Guest seeking accommodation is deemed liable to behave, or has behaved, in a manner that violates laws or regulations, or that is contrary to public order or good morals with respect to accommodation;
      2. When the Guest seeking accommodation is clearly carrying an infectious disease;
      3. When the Hotel is requested to assume an unreasonable burden with respect to accommodation;
      4. When the Hotel is unable to provide accommodation due to natural calamities and/or other cases of force majeure;
      5. When the provisions of Article 16 of the Nagano Prefectural Ordinance for Enforcement of the Hotel Business Act are applicable.
      6. When the Guest smokes in a location other than the designated smoking area, disables firefighting equipment, or takes actions that are prohibited under the Rules of Use stipulated by the Hotel (limited to those deemed necessary for fire prevention); or
      7. When the Guest seeking accommodation is a crime syndicate, a member of a crime syndicate, an organization or an individual related to a crime syndicate, or some other antisocial force.
    2. If the Hotel cancels the Accommodation Agreement in accordance with the preceding Paragraph, the Hotel may not charge the Guest for any services that the Guest has not received.
  • Article 8 (Accommodation Registration)

    1. The Guest shall register the following particulars at the front desk of the Hotel on the day of accommodation:
      1. Name, age, sex, address, and occupation of the Guest (s);
      2. For non-Japanese: Nationality, passport number, port and date of entry in Japan;
      3. Date and estimated time of departure; and
      4. Other particulars deemed necessary by the Hotel.
    2. If the Guest wishes to pay the Accommodation Charges prescribed in Article 12 by any means other than Japanese currency, such as by traveler’s check, coupon, or credit card, the applicable means of payment must be presented in advance at the time of registration, as prescribed in the preceding Paragraph.
  • Article 9 (Guest Room Occupancy Hours)

    1. The Guest may occupy the room in the Hotel from 2:00 p.m. to 11:00 a.m. the next morning. However, if staying for multiple nights in a row, the Guest may occupy the room all day long, except for the days of arrival and departure.
    2. Notwithstanding the provisions of the preceding Paragraph, the Hotel may permit the Guest to occupy the room beyond the time prescribed in the same Paragraph. In this case, extra charges shall be paid as follows:

      - 5,500 yen for a one-hour extension
      *Rooms will not be available for use after 12:00 p.m. on the day of departure.

  • Article 10 (Compliance with the Rules of Use)

    1. The Guest shall comply with the Rules of Use stipulated by the Hotel, which are posted within the premises of the Hotel.
  • Article 11 (Service Hours)

    1. The service hours of the main facilities, etc. of the Hotel are as follows, and the specific service hours of other facilities, etc. are listed in the brochures provided, posted throughout the Hotel, and/or detailed in the guest room service directory.
      1. Service hours of the front desk, cashier’s desk, etc.
        1. Entrance door closing time: Midnight[0:00 a.m.]
        2. Front desk service: 7:00 a.m. to 10:00 p.m.
      2. Service hours (of facilities) for dining, drinking, etc.
        1. Breakfast: 8:00 a.m. to 10:00 a.m. (banquet hall, restaurant)
        2. Dinner: 5:30 p.m. to 9:30 p.m. (banquet hall, restaurant)
        3. Other meals, drinks, etc.
        4. Lounge and Bar: 8:00 a.m. to 9:30 p.m.
      3. Service hours of auxiliary facilities
        1. Shop: 8:00 a.m. to 8:00 p.m.
    2. The service hours set forth in the preceding Paragraph are subject to temporary change due to unavoidable reasons. In such a case, notification will be provided via appropriate means.
  • Article 12 (Payment of Accommodation Charges)

    1. A breakdown of the Accommodation Charges, etc. that the Guest is to pay is provided in the attached Table No.1.
    2. Accommodation Charges, etc. as mentioned in the preceding Paragraph shall be paid in Japanese currency or by a means other than Japanese currency, such as traveler’s check, coupon, or credit card recognized by the Hotel, at the front desk at the time of the Guest’s departure or when requested by the Hotel.
    3. Accommodation Charges shall be paid even if the Guest voluntarily chooses not to stay after the Hotel has provided a useable guest room.
  • Article 13 (Liabilities of the Hotel)

    1. The Hotel shall compensate the Guest for any damage incurred in the course of fulfilling, or failing to fulfill, of the Accommodation Agreement and/or any other related agreements. However, this shall not apply if the damage is due to reasons not attributable to the Hotel.
    2. The Hotel has received the "PASS MARK" (Certificate of Excellence of Fire Prevention Standards) from the fire department. In addition, for further safety, the Hotel is also covered by Hotel Liability Insurance in order to deal with unexpected fires and/or other disasters.
  • Article 14 (Handling When Unable to Provide Contracted Rooms)

    1. If unable to provide contracted rooms, the Hotel shall, with the consent of the Guest, arrange accommodation of the same standard elsewhere for the Guest insofar as is practicable.
    2. Notwithstanding the provisions of the preceding Paragraph, if other accommodation cannot be arranged, the Hotel shall pay the Guest compensation in an amount equivalent to the applicable cancellation charges, and said compensation shall cover any damages incurred. However, if the Hotel is unable to provide a room due to reason not attributable to the Hotel, then the Hotel will not pay compensation.
  • Article 15 (Handling of Deposited Articles)

    1. The Hotel shall compensate for damage in the event that goods, cash, or valuables deposited at the front desk by the Guest are lost, broken, or otherwise damaged, except when due to cases of force majeure. However, in the case of cash and/or valuables, if the Hotel has requested the Guest to report the kind and value but the Guest has failed to do so, then the amount of compensation shall not exceed 150,000 yen.
    2. The Hotel shall compensate for damage in the event that goods, cash, or valuables brought into the Hotel by the Guest but not deposited at the front desk are lost, broken, or otherwise damaged due to willful misconduct or gross negligence on the part of the Hotel. However, in the case of articles for which the kind and value have not been reported in advance by the Guest, the amount of compensation shall not exceed 150,000 yen, except when due to willful misconduct or gross negligence on the part of the Hotel.
  • Article 16 (Custody of the Luggage or Personal Belongings of the Guest)

    1. If the luggage of the Guest arrives at the Hotel prior to accommodation, the Hotel shall be liable for its custody if and only if the Hotel agreed to do so prior to its arrival. Luggage will be handed over to the Guest at the front desk at the time of check-in.
    2. If the luggage or belongings of the Guest are discovered to have been left behind after check-out, once ownership is confirmed, the Hotel shall inform the owner and ask for further instructions. However, if the owner provides no instructions or if the owner cannot be confirmed, the Hotel shall retain custody for a period of seven days, including the day of discovery, before disposing of the article or delivering it to the appropriate authorities. However, food and beverages will be disposed of on the same day.
    3. The Hotel’s liabilities with respect to custody of the luggage or personal belongings of the Guest as set forth in the preceding two Paragraphs shall be as stipulated in the provisions of Paragraph 1 of the preceding Article in the case provided for Paragraph 1, and the provisions of Paragraph 2 of the same Article in the case provided for Paragraph 2.
  • Article 17 (Liabilities Relating to Parking)

    1. If the Guest makes use of the Hotel’s parking lot, the Hotel shall bear no liability for the custody of the vehicle, regardless of whether or not the key is deposited for safekeeping, as the Hotel is simply offering the space for use. However, the Hotel shall compensate for any damage due to willful misconduct or gross negligence on the part of the Hotel in the course of managing the parking lot.
  • Article 18 (Liabilities of the Guest)

    1. The Guest shall compensate the Hotel for any damage due to willful misconduct or gross negligence on the part of the Guest.

  • Note:

    1. The Basic Accommodation Charge is as posted at the front desk.
    2. The child rate applies to elementary school students and younger. 80% of the adult rate is charged when meals and bedding equivalent to those for adults are provided, 60% when meals and bedding for children are provided, 50% when meals and bedding for toddlers are provided, and a facility usage fee of 3,300 yen is charged when no meals or bedding are provided.
    3. If the number of contracted days is reduced, the penalty incurred shall be for one day (the first day) regardless of the number of days reduced.
    4. In the event of partial cancellation of a contract by a group of guests (15 or more), no penalty will be charged for 10% (fractions rounded up) of the number of guests as of 10 days prior to the date of stay (or the date of acceptance if the application was accepted on a later date).

Privacy Policy

Tateshina Shinyu Onsen adheres to the following regarding the protection of Guests’ personal information.

  • *SSL encryption technology is used for reservations on the website.
  • *The Hotel is covered by AIG’s personal information leakage insurance.
  1. Yukiteru Yanagisawa, representative director and president, is responsible for the management of information pertaining to Guests (hereinafter “personal information”).
  2. The Company shall take safety measures for both hardware and software against personal information-related risks, such as unauthorized access to personal information and leakage of personal information.
  3. The Company shall properly manage personal information collected from Guests, and shall not provide or disclose personal information to any third party, except when required by law or when necessary to protect the rights or property of the Company.
  4. The Company may email Guests information on services likely to be beneficial to them. Guests may opt out of receiving such emails by contacting the Company.
  5. If it is necessary to correct the registered information, please contact us directly.
  6. The Company shall comply with all applicable laws, regulations, and norms pertaining to the personal information retained by the Company, and shall review and improve the efforts set forth above as appropriate.
